TERMS AND CONDITIONS

1. Services
BY JASMINE LETTS provides social media content creation services, including photography and video captured primarily using mobile devices including iPhones for use in marketing, social media, and online promotion.
We do not guarantee business results, audience growth, sales, or viral performance, only the delivery of creative services.
2. Booking, Deposits and Payment
All bookings require a non refundable 50% deposit to secure your session.
A booking is not confirmed until the deposit has been received.
The remaining 50% is due on or before delivery of the final content.
BY JASMINE LETTS reserves the right to withhold any content until full payment has been received.
If any payment remains unpaid for more than 7 days, BY JASMINE LETTS may charge statutory interest and recovery costs in accordance with the Late Payment of Commercial Debts Interest Act 1998.
Once any content has been delivered including previews drafts or final files, all payments are non refundable.
3. Content Delivery
Estimated delivery times will be provided at the time of booking. These are estimates only and not guaranteed.
BY JASMINE LETTS is not liable for delays caused by editing complexity, client feedback delays, illness, technical issues or force majeure events.
Delivery is considered complete once content has been sent via download link cloud folder or other agreed method.
4. Ownership and Usage Rights
All content created by BY JASMINE LETTS remains our intellectual property until full payment has been received.
Once paid, the client is granted a non exclusive and non transferable licence to use the content for social media websites online advertising and marketing and promotional purposes.
Clients may not sell license or provide the content to third parties, claim the content as their own work, or use the content in misleading unlawful or harmful ways.
BY JASMINE LETTS retains the right to use all content for portfolio website social media and marketing unless otherwise agreed in writing before the shoot.
Once content has been published by BY JASMINE LETTS, requests to remove it may be refused unless legally required.
Where content is posted on social media, the client agrees to tag or credit BY JASMINE LETTS where reasonably possible unless otherwise agreed in writing.
5. Platform and Advertising Policies
BY JASMINE LETTS is not responsible if content is rejected limited removed or restricted by any social media advertising or content platform.
6. Cancellations and Rescheduling
At least 24 hours notice is required to cancel or reschedule a booking.
If cancelled with less than 24 hours notice or if the client fails to attend, the 50% deposit is forfeited.
If sufficient notice is given, the deposit may be transferred to a new booking date within 30 days subject to availability.
7. Client Responsibilities
The client confirms that they have permission to film at the location, that anyone appearing in the content has given consent, and that any logos music branding or materials provided are legally owned or licensed.
BY JASMINE LETTS is not responsible for legal copyright or trademark issues arising from client provided materials.
8. Creative Style Revisions and Complaints
All work is produced in BY JASMINE LETTS professional creative style.
Because creative work is subjective, refunds are not given based on personal preference.
Revisions are limited to what was agreed before filming.
Any complaints must be made within 7 days of content delivery.
9. Raw Files
Unless agreed in writing, BY JASMINE LETTS is not required to provide raw unedited footage or original files.
10. File Storage
BY JASMINE LETTS does not guarantee long term storage of any content. Clients are responsible for downloading and backing up their files upon delivery.
11. Liability
BY JASMINE LETTS is not liable for loss of profits, loss of business, marketing or social media performance, or algorithm changes.
Our maximum liability is limited to the total amount paid for the services.
12. Client Indemnity
The client agrees to indemnify and hold harmless BY JASMINE LETTS from any claims damages legal fees or losses arising from the client business products services or use of the content.
13. Right to Terminate
BY JASMINE LETTS may suspend or terminate services if the client breaches these terms behaves abusively or fails to make payment.
Any payments made remain non refundable.
14. Independent Contractor
BY JASMINE LETTS acts as an independent contractor. Nothing in these terms creates a partnership joint venture or employment relationship.
15. Equipment
Clients acknowledge that content is captured using mobile devices including iPhones as part of our professional workflow.
16. Force Majeure
BY JASMINE LETTS is not liable for delays or failure to perform services due to events beyond our reasonable control including illness injury extreme weather transport failure equipment malfunction venue closure or government restrictions. Where possible bookings will be rescheduled but refunds are not guaranteed.
17. Governing Law
These terms are governed by the laws of England and Wales.
